By accessing or using capsl ("we", "us", "our"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.
1. Services Provided
capsl is a daily journaling app that helps you capture your day through photos and screenshots. The app uses AI to analyze screenshots and extract metadata (music, articles, social posts) to enrich your journal entries. Features may change or be discontinued at any time.
2. Eligibility
You must be at least 13 years old (and, where required, have parental/guardian consent if under 18). You are responsible for how you use the app on your device and for complying with these Terms.
3. Subscriptions and Payments
Some features require a paid subscription with auto-renewal until canceled. Pricing and terms are shown in-app and may vary by region. Manage/cancel via your device's subscription settings. Billing and refunds are handled by the app store and subject to its policies.
We may suspend or cancel access to premium features or terminate your subscription if you violate these Terms, including in cases of security abuse, hacking attempts, reverse engineering, or prompt/LLM injection. Any billing, refunds, or cancellations are handled according to the app store's policies.
4. Permissions and Accuracy
The app needs photo library access to save screenshots locally on your device and automatically detect new screenshots for analysis. All your data is stored on your device and your personal iCloud — we do not store your photos or screenshots on our servers. Optional permissions include notifications. Revoking permissions may disable related features. AI-powered screenshot analysis may contain errors; review extracted information for accuracy.
5. Acceptable Use
Do not use the app unlawfully, infringe others' rights, attempt unauthorized access, disrupt the service, send spam or malware, impersonate others, or collect others' data without consent. Do not attempt to bypass security, reverse engineer, or manipulate AI components (including prompt/LLM injection, jailbreaking, or adversarial inputs) to extract hidden data or override safeguards.
6. Privacy
Your use is subject to our Privacy Policy, which explains what we collect and how we use it.
7. Disclaimer
The service is provided "as is" and "as available," without warranties of any kind, including accuracy of AI analysis, uninterrupted operation, or error-free results.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages (including lost data or missed entries). Any direct liability is limited to amounts you paid in the 12 months before the claim.
9. Suspension and Deactivation
We may immediately suspend or permanently deactivate access to premium features or the app (with or without prior notice) if we reasonably believe you engaged in any of the following:
- DDoS/Network attacks — flooding, botnets, traffic spikes to disrupt service.
- Automated interaction — any unauthorized automation/botting against the app or API.
- Prompt/LLM injection — attempts to extract hidden instructions, jailbreak models, or tamper with AI behavior.
- Exploiting vulnerabilities — circumventing paywalls, subscription checks, rate/quota limits, or security controls.
- Harassment/Hate speech — threats, abusive content, extremist propaganda, or non-consensual intimate content.
- IP infringement — uploading or distributing content you do not own or have rights to.
- Security threats — malware distribution, phishing, fraud, money-laundering, or any activity threatening security, privacy, or compliance.
In urgent cases (e.g., security breaches) suspension may be immediate. For less severe violations, we may send a warning giving 48 hours to cure. Appeals can be lodged via: poteminr@gmail.com.
10. Changes
We may update these Terms by posting a new version with an updated Effective Date. Continued use means acceptance of the updated Terms.
